Refund policy
Introduction
SafetyPoint (Midlands) Limited operates exclusively on a Business to Business basis. This policy sets out our approach to returns and defective goods in line with our Standard Terms of Supply. Consumer protection legislation does not apply to these transactions. For transparency, we reference relevant Business to Consumer legislation for information only.
Scope
This policy applies to all goods supplied under Business to Business contracts governed by SafetyPoint’s Standard Terms of Supply. It covers warranty obligations, defect reporting, and available remedies.
Applicable Legislation
- Sale of Goods Act 1979. Implied terms apply unless excluded by contract. Our Standard Terms exclude sections 13 to 15 to the fullest extent permitted by law.
Warranty Terms
- Warranty Period: 12 months from delivery.
- Coverage: Conformity with specification, free from material defects, satisfactory quality, and fitness for purpose.
- Exclusions: Misuse, failure to follow instructions, fair wear and tear, customer supplied design or specification, and unauthorised alterations.
- Implied Terms: Sections 13 to 15 of the Sale of Goods Act excluded.
Defect Reporting and Remedies
- Notification: Written notice must be provided within a reasonable time of discovery during the warranty period.
- Inspection: SafetyPoint must be given a reasonable opportunity to examine the goods.
- Return: The customer must return goods at their own cost if requested.
- Remedies: At SafetyPoint’s option, defective goods will be repaired, replaced, or refunded in full.
Limitations
- Liability is capped at the value of the products purchased.
- No liability for consequential or indirect losses including loss of profit, business, or goodwill.
- Risk passes on delivery. Title passes only after full payment is received.
Business to Consumer Transactions (Reference Only)
For consumer transactions, statutory rights under the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and Consumer Protection Act 1987 apply. These provisions do not apply to Business to Business transactions.
- Consumer Rights Act 2015: Includes 30 day right to reject, repair or replacement obligations, and a final right to reject.
- Consumer Contracts Regulations 2013: Provides a 14 day cooling off period for distance sales and refund obligations.
- Consumer Protection Act 1987: Imposes strict liability for defective products that cause harm.
Governing Law
This policy and all contracts are governed by the law of England and Wales, with exclusive jurisdiction of its courts.
